What Is Divorce Mediation?
In mediation, the divorcing couples come together to try to work out a solution to a disputed issue in their divorce. A variety of divorce-related matters can be resolved through mediation:
Mediation allows the couple to take control of how and what decisions are made. In divorce litigation, a judge (who does not know anyone involved or the unique situations involved) will make these decisions.
The Mediation Process
The mediation process involves a group of sessions where you and your spouse (and your respective divorce lawyers) meet to discuss the issues. A family mediator — a neutral third party who is frequently an attorney or retired judge — will facilitate these mediation sessions. The mediator is objective throughout the mediation process, not taking sides and remaining focused on helping the couple come to agreement somewhere in the middle on disputed issues. Occasionally, it may be necessary to end a session in order to provide a "time-out" period to diffuse an escalating situation and allow the spouses to regain focus on the goal — a workable divorce settlement agreement that everyone can live with.
