Child Support Calculations in Pennsylvania
Under Pennsylvania child support laws, child support is determined based upon the reasonable needs of the children being supported and the parent's ability to pay. Therefore, child support amounts are calculated by factoring the net incomes of both parents and the number of children being supported. Deviations to the formula may be approved where special conditions exist such as the ability of one parent to provide health insurance coverage for the children where the other parent cannot.
Spousal Maintenance (Alimony) in Pennsylvania
Spousal maintenance (also referred to as spousal support or alimony) is determined by the reasonable needs of the parties. Spousal support may or may not be warranted. When the court is examining whether support is warranted, it considers a number of factors, such as the earning capacity of both parties, the length of the marriage, whether one party was out of the workforce for an extended period, the age and health of the parties and many other factors. Spousal support agreements may be offset by the division of marital assets.
